New Trademark Bill in India

Recognizing a need to amend the existing trademark law, Indian legislative bodies have proposed a new Trademark Bill known as the Trade Mark (Amendment) Bill 2007 by which a new chapter IV A has been incorporated. The aim of the bill is to amend the trade mark laws in India so as to afford protection to the Indian trade mark in other countries as well.

One of the important features of the Bill is that it empowers the Registrar of Trade Marks to deal with international applications originating from India and abroad and maintain a record of international registrations. Other amendments include reduction of the time period of filling of notice of opposition of published applications to three months and simplification of the provision related to transfer of ownership trade marks by assignment or transmission.
Changes in Patent Law in India

Under the Patents (Amendment) Rules, 2006, official fees can now be paid through electronic means. Further applications are to be published in the Journal one month after expiry of the statutory period of 18 months or one month from the date of request for publication under Rule 24A in case of request for an early publication. Apart from these other sweeping changes have also been made for transparency in grant of Patent. The rules have also made it mandatory to issue the patent certificate within 7 days from the grant of Patent.
New Design Regulations in India

The Government is proposing to amend the rules governing designs in India and for the purpose has recently drafted Design Amendment Rules. Some of the changes include scrapping the requirement of using cardboard paper and using A4 size paper for filing design applications instead. Other changes include using strong glue paper for affixing the photograph instead of cello tape or staple pin and extension of time for putting in application in order for acceptance.
